Franklin County Sheriff announces the arrest of 5 Sex Offenders
Franklin County Sheriff Kevin Mulverhill and District Attorney Derek Champagne today announced the arrest of five sex offenders in Franklin County. Sheriff Mulverhill stated that these arrests are a result of a two month long sweep that involved the Franklin County Sheriff’s Deputies, U.S. Marshalls, New York State Police, Malone Village Police and the District Attorney’s Office. All five arrests are for Sex Offender Registry violations, Class E felonies.
Three of these arrests were subjects who were convicted of sex crimes in the State of Massachusetts, thereafter moved to Franklin County and failed to register with the New York State Department of Criminal Justice Services per the conditions of their level 3 sex offender status.
Carl Grant 05/16/68, Constable, NY was convicted of Indecent Assault of a child under 14 yrs of age and Assault with intent to rape a child in Massachusetts. He moved to this area several years ago and did not register as a sex offender as required by law. He was discovered as a result of a Bingo license application. Any establishment wishing to hold Bingo games is required to apply for a license through New York State. Part of that application is reviewed by the County Sheriff who is responsible for ensuring that those parties listed on the application have not been convicted of a crime and are of good moral character. Mr. Grant’s name appeared on an application and as a result of a records check conducted by the Franklin County Sheriff’s Department it was discovered he was a sex offender that had not registered as required. On 03/13/12 Franklin County Sheriff’s Deputies arrested Mr. Grant for failing to register as sex offender. He was arraigned in the Town of Malone and released on $1,000.00 bail.
Leo Labrake 07/20/47, Boomingdale, NY was convicted of Indecent Assault and Battery on a child under 14 yrs of age on two different occasions in the state of Massachusetts. An anonymous person contacted the Franklin County Sheriff’s Department and reported that a level 3 violent sex offender was living in the Town of Franklin. This person had developed the information as a result of an internet search of Leo Labrake. An investigation was conducted by Franklin County Sheriff’s deputies and it was discovered that Mr. Labrake had recently moved to the area and had failed to register as a sex offender as required. On 03/13/12 deputies arrested Mr. Labrake for failing to register as a sex offender. He was arraigned in the town of Malone and released on $1,000.00 bail.
Ronald Forrette, 07/10/61 Chateaugay, NY was convicted of Indecent Assault and battery on a child under 14 yrs of age and Indecent assault and battery on a person 14yrs or older in the state of Massachusetts. An anonymous person contacted the Franklin County Sheriff’s Department to report that a level 3 sex offender was living in the Village of Chateaugay and that he had stated he was preparing to leave the area soon. The caller had discovered that Mr. Forette was a level 3 sex offender as a result of an internet search. Franklin County Sheriff’s deputies conducted an investigation and because of the information that he was about to flee the information was turned over to the New York State Police. On 02/24/12 Mr. Forette was arrested by the New York State Police for failing to register as a sex offender. He was arraigned in the Town of Westville and remanded to the Franklin County Jail in lieu of $10,000.00 bail. The U.S. Marshall Service is also pursuing federal charges.
The remaining two arrests that resulted from this sweep are local sex offenders that failed to update their address with the sex offender registry.
Howard Nichols 02/16/79 Malone, NY is a level 3 registered sex offender as a result of a conviction for Sexual Abuse 1st degree involving two children under the age of 11. Information developed by the Malone Village Police Department indicated that Mr. Nichols had moved from his previously registered address into the Village of Malone and failed to update with the sex offender registry within 10 days as required. Malone Village Police turned the information over to Sheriff’s Deputies and on 03/08/12 Mr. Nichols was arrested for failing to update the sex offender registry with his current address. He was arraigned in the Town of Malone and remanded to the Franklin County Jail in lieu of $2,500.00 bail.
Sean Dibble 08/17/73 Bombay, NY is a level 1 registered sex offender as a result of a conviction for Rape 3rd involving a child less than 12 years old. An anonymous caller contacted the Sheriff’s Department to inquire as to the registered address of Mr. Dibble. An investigation conducted by Sheriff’s Deputies indicated Mr. Dibble had moved from his registered address and had failed to notify the sex offender registry within 10 days as required. On 03/13/12 Mr. Dibble was arrested by Sheriff’s Deputies for failing to update the sex offender registry with his current address. He was arraigned in the Town of Malone and remanded to the Franklin County Jail in lieu of $1,000.00 bail.
Sheriff Mulverhill reported there are over 135 registered sex offenders residing in Franklin County. These do not include the inmates incarcerated in any of the New York State Correctional Facilities. There are over 45 Level 3 sex offenders in the county with 21 of those being held at Sunmount in Tupper Lake. Level 3 sex offender status contains those offenders considered by the courts to be the most likely to repeat offenses and may pose a greater threat to public safety. Level 2 & 3 must register with the sex offender registry for life unless otherwise relieved by the courts. Most level 1 sex offenders must register with the sex offender registry for 20 years after conviction. Level 1 offenders are designated as the least likely to repeat. Risk level and designation are determined by the court in which the offender was convicted.
Designated Sex Offenders Must:
- Report annually to DCJS in writing by signing a verification form their address.
- Notify DCJC, in writing, of a new address within 10 days after moving
- Report to local police agency and have photo taken (every year for level 3 and every 3 years for levels 1 & 2
- Notify DCJS, in writing of, enrollment, living address or employment of any institution of higher education within 10 days after the change
- Provide in writing, internet service providers, screen names and email accounts
- Level 3 offenders must personally verify their address every 90 days with local law enforcement.
Sheriff Mulverhill and DA Champagne thanked all of the agencies involved in the arrest of these 5 individuals and especially thanked those anonymous tipsters that provided the information that led to the arrest of 3 out of the 5. DA Champagne said those arrest that came about as the result of anonymous callers indicate how important it is for everyday citizens to provide information they may have obtained from the internet regarding sex offenders to local law enforcement. A couple of internet searches could be the bit of information law enforcement needs to arrest those sex offenders who refuse to comply with the law.
Sheriff Mulverhill added that this roundup was just the beginning and promised that over the coming months Sheriff’s Deputies would be conducting random address checks for those sex offenders registered within Franklin County. Let this be fair warning to those sex offenders that think no one is watching. The Franklin County Sheriff’s Department along with the State Police and the Local Village Departments are prepared to seek out those that refuse to comply with the registry requirements and arrest them. The protection of our children and fellow citizens from these sex offenders is a responsibility we take very seriously.
